Welcome to Silverstein Exchange (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, https://silversteinx.com (the “Site”), and the services we provide through it (“Services”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Eligibility

You must be at least 18 years old or the legal age in your jurisdiction, and capable of entering into legally binding agreements, to use Silverstein Exchange.

2. User Accounts

  • Users must register to buy or sell on the platform.

  • You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Listings and Auctions

  • All listings must be accurate, complete, and reflect the true condition of the instrument.

  • Silverstein Exchange reserves the right to approve, edit, reject, or remove listings at any time.

  • Artist-Owned listings must be verified for provenance upon request.

  • Misrepresentation may result in suspension or removal from the platform.

4. Pricing, Fees, and Buyer Responsibilities

  • Sellers set their own pricing or auction reserve values.

  • Silverstein Exchange may charge listing, promotional, or transaction fees, which will be disclosed in advance.

  • Buyers are responsible for applicable taxes, customs duties, and import/export compliance.

  • Buyers may also be responsible for shipping costs unless Free Shipping is clearly provided by the seller.

5. Payment and Escrow

  • All payments are securely processed via third-party gateways including PayPal and Stripe.

  • For selected transactions, such as artist-tier or high-value listings, funds are held in escrow until the buyer confirms receipt and satisfaction.

  • Not all transactions use escrow; lower-value items may be processed without escrow. Escrow eligibility will be clearly indicated at checkout.

  • Buyers have 14 days from the confirmed delivery date to approve or dispute a transaction. If no response is submitted, funds are automatically marked as accepted on day 15.

  • Seller payouts will be processed 15 days after the product is marked delivered, allowing the full return window to close. This applies to both escrow and non-escrow transactions.

  • Sellers should be aware that shipping delays or customs inspections may extend the delivery timeline. Payout schedules begin only after confirmed delivery, not from the shipment date.

6. Auction Transactions and Deposits

For items sold through auction, the following conditions apply:

    • Deposit Requirement: A $500 deposit is required before putting the first bid. If the bidder doesn’t win, the deposit will be fully refunded immediately after the auction closes.

    • Winning the Auction: If you win, you’ll receive an email with a payment link. You may pay by credit card or bank transfer, and the full balance must be received within 10 days of the auction’s closing. Once your payment is received, the $500 auction deposit will be refunded to your original payment method.

    • The wire transfer must arrive within 10 calendar days of the auction closing date. If payment is not received within this period, the transaction will be considered void, the deposit forfeited, and the item may be relisted or offered to another buyer.

    • No item will be shipped until the full payment has cleared.

7. Shipping, Taxes, and International Compliance

  • Buyers are responsible for taxes, customs duties, and import/export compliance according to local regulations.

  • Items shipped internationally may be subject to customs processing based on declared value.

  • Sellers must accurately declare the item’s customs value and comply with customs declaration laws.

  • Buyers acknowledge and accept the possibility of:

    • Delays due to customs inspections

    • Import duties and taxes imposed by their country

    • Brokerage fees payable upon delivery

8. Returns and Refund Policy

  • Buyers may request a return within 14 days of delivery.

  • All return requests are subject to review and approval by Silverstein Exchange.

  • Buyers are responsible for return shipping in case of return for refund. Buyers must use secure, trackable, insured shipping method when return.

  • Returned items must be in the same condition as shipped:

    • No damage

    • No scratches

    • No modifications or alterations

  • All returns are inspected upon receipt. If the item is found to be altered or damaged, the return will be rejected, and the item will be returned to the buyer.

  • In such cases, buyers must pay the return shipping costs.

  • Approved returns will receive a full refund through the original payment method, including escrow reversal when applicable.

9. Prohibited Conduct

Users may not:

  • List or sell counterfeit or stolen items

  • Circumvent platform processes or fees

  • Post false, misleading, or abusive content

  • Violate intellectual property rights or any law

  • Attempt to manipulate pricing, listings, or ratings

  • Engage in off-platform transactions for listed items

Violations may result in account suspension or permanent removal.

10. Intellectual Property

All content, branding, logos, design, and code on Silverstein Exchange are the property of the Company or its licensors. You may not use, reproduce, or distribute any part of the Site or its content without written permission.

11. Disclaimer of Warranties

Silverstein Exchange provides the platform “as is” and “as available” with no warranties, express or implied.
We do not guarantee:

  • That the platform will be uninterrupted or error-free

  • That listings will meet user expectations

  • That transactions will be successful or profitable

Your use of the platform is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, Silverstein Exchange shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of profits, data, or reputation

  • User disputes or transaction-related losses

Total liability is limited to the greater of $100 USD or the amount paid to Silverstein Exchange in the 12 months prior to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Silverstein Exchange, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the platform

  • Your violation of these Terms

  • Your violation of any law or third-party rights

  • Any content you submit or transactions you conduct through the platform

14. Dispute Resolution and Arbitration

Binding Arbitration

Any dispute relating to these Terms or the use of our Services will be resolved through binding arbitration in Bergen County, New Jersey, under the rules of the American Arbitration Association (AAA).

Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class, collective, or representative proceeding.

Waiver of Jury Trial

You waive your right to a trial by jury for any dispute arising from these Terms or the platform.

15. Termination

We may suspend or terminate your account at any time for violations of these Terms, legal non-compliance, or behavior deemed fraudulent or harmful.

16. Governing Law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of law principles.

17. Changes to These Terms

We may update these Terms periodically. Changes will be posted on this page with an updated effective date. Continued use of the Site means you accept the updated Terms.
